Agreement & Acceptance

By downloading, accessing, or using the CMX Haul App (“App”), you agree to these Terms & Conditions. If you do not agree, you should not use the App.


Nature of Service

CMX Haul provides a digital platform that connects Shippers and Carriers for transportation and logistics services.

  • Shippers are users who request transportation.

  • Carriers are drivers or transport companies that provide hauling services.

CMX Haul does not operate vehicles and is not a carrier unless specifically stated in a separate written agreement. All responsibility for transportation and cargo handling rests with the Carrier.


User Responsibilities

Shippers’ Responsibilities
Shippers must provide accurate cargo information, properly package and label goods, declare hazardous or restricted materials, and pay all required fees.

Carriers’ Responsibilities
Carriers must hold valid Jamaican licences, permits, and insurance, maintain their vehicles safely, follow proper cargo securing rules, and deliver shipments only to authorized recipients.

Prohibited Activities
Users may not use the App to provide false information, commit fraud, ship illegal or prohibited items, or interfere with the operation of the platform.


Payments & Fees

All fees, commissions, and charges are displayed within the App. Payments are handled through approved third-party payment processors. Cancellation and refund conditions vary based on each booking. Taxes related to transactions are the responsibility of the User.


Insurance & Cargo Liability

Carriers must maintain all legally required insurance, including cargo liability insurance of at least J$10,000,000 per load.
Carriers are responsible for any cargo loss or damage unless stated otherwise by law.
CMX Haul is not responsible for cargo loss unless it is acting as the Carrier under a separate written agreement.
Shippers are fully responsible for undeclared hazardous goods or improperly packaged items.


Disclaimer & No Warranty

The App and its services are provided “as is” and “as available.”
CMX Haul makes no guarantees regarding App availability, accuracy of information, or the conduct of other users. No warranties—express or implied—are provided.


Limitation of Liability

CMX Haul’s total liability is limited to the lesser of J$5,000,000 or the amount of service fees paid by the User during the previous 12 months.
The Company is not liable for indirect, consequential, or incidental damages, loss of business, loss of profits, or delays caused by third parties or force majeure events.


Indemnification

Users agree to indemnify and hold CMX Haul harmless against claims arising from violations of these Terms, unlawful activities, or losses caused by incorrect cargo information or negligence.
CMX Haul will indemnify Users only when loss is directly caused by the Company’s gross negligence or fraud.


Intellectual Property

All software, design elements, logos, and content within the App belong to CMX Haul. Users receive a limited licence to use the App and may not copy, alter, or distribute any material.


Account Suspension or Termination

CMX Haul may suspend or terminate a User account for legal violations, fraud, safety risks, or non-compliance with these Terms. In severe cases, termination may occur immediately.


Dispute Resolution

The parties will attempt to resolve disputes informally. If unresolved, disputes proceed to mediation. If mediation does not resolve the matter, it will be referred to binding arbitration in Kingston, Jamaica under the Jamaican Arbitration Act.
CMX Haul may pursue urgent court remedies where necessary.


Governing Law

These Terms are governed by the laws of Jamaica. Any legal proceedings fall under the exclusive jurisdiction of Jamaican courts.


Changes to These Terms

CMX Haul may update or revise these Terms at any time. Notifications will be provided through the App or email. Continued use after updates constitutes acceptance.
